Article 1 – General Provisions – Scope of Application

 

1.1         These General Terms and Conditions of Sale ("GTC") define the rights and obligations of the parties in connection with the online sale of products offered by the company L.VINTAGE ("the Company").

 

1.2         These GTC apply to any Order placed on the website by an adult individual acting as a consumer.

The Customer therefore certifies:

  • being over 18 years old,

  • acting for purposes outside the scope of professional activity,

  • having full legal capacity to enter into commitments,

  • providing accurate information regarding their identity.

 

1.3         Exclusion: Professionals (individuals or legal entities acting within the scope of their commercial, industrial, craft, liberal, or agricultural activity) are excluded from the scope of these GTC. Professionals wishing to order are invited to contact the Company directly.

 

1.4          The applicable GTC are those in force on the date of the order. The Company reserves the right to modify them at any time, with the new version being published on the website.

 

Article 2 – Online Contract Conclusion

 

2.1  Order Process

  • The Customer selects the Products and adds them to their cart.

  • After checking the cart and reading the GTC, validating the order (2nd click) constitutes acceptance and entails an obligation to pay.

  • The Customer then proceeds to payment using the proposed methods.

  • An order confirmation is sent by e-mail, with a summary, price, delivery costs, and order number.

 

2.2  Order Refusal
The Company reserves the right to refuse an Order for any legitimate reason (abnormal order, previous dispute, suspicion of fraud, non-payment…).

 

2.3  Order Cancellation
A cancellation request is possible before preparation or shipment. If the order has already been shipped, the Customer must return it at their own expense to obtain a refund.

 

Article 3 – Products and Availability

 

3.1  Specifications
The essential characteristics of the Products are presented on the website. Photos and videos are non-contractual.

 

3.2  Availability
Offers are valid while stocks last. In case of unavailability after ordering, the Customer will be informed by e-mail and will be refunded the amount of the unavailable Product.

 

Article 4 – Price

 

Product prices are indicated in euros, all taxes included, excluding delivery costs. Delivery costs are specified during the order.

 

Article 5 – Payment

 

5.1  Time of Payment
Payment is due immediately upon order validation.

5.2  Payment Methods

  • Bank card (Visa, Mastercard, American Express, Maestro) via a secure platform (SSL).

  • PayPal (up to €1000).

  • Vouchers and promotional codes valid once.

In case of payment authorization refusal or suspicion of fraud, the Company reserves the right to cancel the order.

 

Article 6 – Delivery

 

6.1         Products are delivered to the address indicated by the Customer or to a relay point. Delivery times are indicated before order validation.
In case of delay due to force majeure (e.g., health crisis, high demand such as Black Friday, end-of-year holidays), the Company will inform the Customer.

 

6.2  Customs Clearance
In case of delivery outside the EU, the Customer is considered an importer and is responsible for any customs duties or local taxes.

 

6.3  Receipt
The Customer must check the condition of the package upon receipt and report any anomaly to Customer Service within 3 working days.

 

Article 7 – Right of Withdrawal

 

7.1  Principle
In accordance with the law, the Customer has a period of 14 calendar days from receipt to exercise their right of withdrawal without having to justify their decision.

 

7.2  Exclusions
The right of withdrawal does not apply to personalized Products, Products unsealed for hygiene reasons, perishable Products, or Products inseparably mixed with other goods.

 

7.3  Terms

  • The Customer notifies their decision by e-mail to: l.vintageparis@gmail.com

  • The Product must be returned in its original condition, complete, unused, within 14 days, with return costs borne by the Customer.

  • The refund (product + delivery costs) will be made within 14 days of receipt of the return.

 

Article 8 – Legal Guarantees

 

Products benefit from the legal guarantee of conformity (articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).
Some Products may benefit from a manufacturer's commercial warranty, specified on the product sheet.

 

Article 9 – Personal Data

 

The Company collects and processes personal data necessary for order processing and customer relationship management. They are kept for 5 years.

In accordance with regulations, the Customer has a right to access, rectify, delete, object to, limit, portability, and post-mortem directives concerning their data.

Article 10 – Intellectual Property

 

The elements of the website (trademarks, texts, images, videos, software, etc.) remain the exclusive property of the Company or their respective owners.

 

Article 11 – Force Majeure

 

The Company cannot be held responsible in case of non-performance due to force majeure.

 

Article 12 – Liability

 

The Company disclaims all responsibility in case of misuse, modification, or alteration of the Product by the Customer.

 

Article 13 – Account Suspension / Termination

 

The Company may suspend or delete a Customer's account in case of breach of the GTC or abusive behavior.

 

Article 14 – Partial Nullity

 

If a clause of the GTC is deemed null and void, the other provisions remain applicable.

 

Article 15 – Applicable Law and Disputes

 

These GTC are subject to French law.

In case of a dispute, the Customer can contact Customer Service at l.vintageparis@gmail.com to seek an amicable solution.
Failing that, the Customer may use a consumer mediator free of charge or the European Commission's online dispute resolution platform: http://ec.europa.eu/consumers/odr/.
